Update decision ACM on ITC

23 January 2025

On 23 December 2024, the Dutch regulator, the Authority for Consumers and Markets (ACM) published its final decision to amend the Transportcode gas LNB introducing a basis to impose an Inter-Transmission System Operation Compensation (ITC) on transmission system operators, more specifically on BBLC.

Under the decision, any transport capacity with a booking date before 1 October 2025 will not be affected by any ITC imposed upon BBLC by ACM.

As BBLC does not agree with the decision by the ACM, it has decided to initiate appeal proceedings with the relevant Dutch administrative court, the College voor Beroep van het bedrijfsleven (CBb). In addition, BBLC will study the impact of the decision on any transport capacity with a booking date made after 1 October 2025 and contact the relevant authorities on this matter.

BBLC will further inform shippers as soon as any new developments arise.
