As from September 1st 2008, BBL Company intends to offer non-physical interruptible reverse flow capacity (IRF), subject to regulatory approval. IRF can be contracted on a monthly basis to a maximum of twelve months upfront. IRF will also be available on a daily basis.
IRF will be sold on a first come first served basis. The sale starts with a subscription period for monthly capacities which ends on Wednesday 20 August 2008 12:00 hours (LET).
Capacity can be requested by completing and signing the "BBL transmission agreement interruptible reverse flow 2008-2" below (transmission agreement), which also contains the applicable tariffs. Interested parties are requested to fax a fully signed transmission agreement to BBL Company: +31 50 521 35 45 for the attention of Commercial Operations. BBL Company advises parties to confirm by email or telephone.
Following the subscription period the order and timestamp of the transmission agreements will be determined by a notary draw. In case of an interruption this timestamp determines the order of the interrupted parties. After the subscription period the first come first served principle is applicable. On Thursday 21 August 2008 at the latest BBL Company will inform all parties that have sent transmission agreements in the subscription period about the outcome of the notary draw, including the amount of capacity already awarded to other parties. In case a certain amount of capacity has already been awarded to (one or more) other parties, a party has the possibility to withdraw its transmission agreement.
By the end of the subscription period interested parties must have fulfilled all conditions of becoming a BBL-Shipper, notably the conditions on creditworthiness and communication. If this is not the case the party involved will be excluded from the notary draw.
When all conditions are fulfilled and party has not withdrawn its transmission agreement BBL Company will countersign the transmission agreement and return a copy per mail.
There is no specific limit on the amount of IRF offered. BBL Company will publish the amount of sold IRF.
With the transmission agreement, it is only possible to request for flat bookings. Any party that wishes to request for a profiled booking, should divide this profile over several transmission agreements and send them all to BBL Company.
To the transmission agreement for IRF the General Terms and Conditions (GTC) Reverse Flow 2008-2 are applicable, including Exhibits A and B. These documents and a protocol regarding how BBL Company handles booking requests after the subscription period are available on this website.
The terms and conditions for IRF including tariffs and allocation mechanism are subject to approval by UK and Dutch regulatory authorities. Any news regarding regulatory approvals will be published on the website.
Interested party's counterparties in the National Grid system have to appoint an exit agent for the allocation of gas flows. For more information in this respect is referred to National Grid.
